Where there is a divorce, husbands and wives both have financial claims against the other person.

Often an agreement or financial settlement can be reached without the parties needing to go to Court. This is our initial priority as court cases can cause stress as well as build up legal and court costs. 

Sometimes the parties will agree to attend family mediation to attempt to reach an agreement on financial issues. We will prepare you fully for mediation. We will prepare the papers and explain to you what you can expect at mediation. Your best interests are always our priority and we will work with you and support and guide you through each step of the legal process.

Sometimes it is not possible for the parties to agree a settlement through negotiation or mediation. In those cases the County Court will be asked to decide the issues and to make a Financial Order.
 

The Court has considerable powers to make orders on all financial issues. The Court will attempt to create a practical solution that fairly divides the assets between the parties.

Even if the Parties reach an agreement on how the Marital assets are divided, there will need to be a formal Court Order setting out that Agreement. Otherwise, if there is no formal Court Order either Party can change their mind.


Another scenario might be that there are no Marital assets when the Parties Divorce, so they decide to walk away with nothing. Without a formal Court Order to say this, one Party can change their mind and bring a Claim against the other Party, at any time in the future.
